Terms and Conditions We Love Footy Tipping Competition (NRL) 8th February 2012 – 2 September 2012 Conditions 1. VARIABLES General: 1.1. Resident of: New South Wales, Australian Capital Territory (ACT) and Queensland in Australia. 1.2. Minimum age: 18 years Dates/Times: 1.3. The competition will commence on 8th February 2012. 1.4. The competition will contain 26 separate Weeks for entry (“Tipping Weeks”) corresponding to the 26 Weeks of matches of the NRL 2012 football season, excluding Finals (known as the “Regular Season”). 1.4.(a). The Weeks of matches for the Regular Season are set out on the Tipping pages of the We Love Footy Tipping Competition website. Postponed, rescheduled or delayed matches will have their match times updated during the season to become part of the next appropriate Tipping Week in which the match will be played. 1.4.(b). The deadline for each Tipping Week (“Deadline”) will be specified on the "My Tips" page in the Tipping Competition section of the We Love Footy website. Unless otherwise specified, the deadline will be five (5) minutes before the commencement of the first match of the round in each Week. 1.4.(c). The day following the completion of each Tipping Week of matches, the winner(s)’ names for the corresponding Tipping Week will appear on the Ladder page of the Tipping Competition section of the We Love Footy website, and will also be notified by We Love Footy via email. 1.4.(d). The names of the Overall Winner and Regional Winners overall competition winner will appear on the We Love Footy Tipping Competition website from Wednesday 5th September 2012, and will be printed in ‘The Australian’ newspaper on Monday, 10th September 2012. 1.5. The competition will close at 7:25pm AEST on Friday 31st August 2012. 2. WHO MAY ENTER The promotion is open to all residents of New South Wales, ACT and Queensland over the age of 18. Employees and immediate families of WIN Corporation licensed television companies, its subsidiaries and associated agencies are not eligible to enter. "Immediate family" means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee/contractor. 3. ENTRANTS BOUND BY CONDITIONS By participating, entrants agree to be bound by these conditions. 4. HOW TO ENTER 4.1. To enter, entrants must complete the competition registration form on the We Love Footy Tipping Competition website, (www.welovefooty.com.au) read these conditions and agree to be bound by these terms and conditions. Entrants must select a valid username and password at the time of registration. 4.2. Entrants are required to select their region from the list provided in the registration form. Based upon the selected region, each entrant will be registered in one of two (2) Regional Tipping Teams in addition to their registration for the overall We Love Footy Tipping Competition. 4.3. The following table outlines the two (2) Regional Tipping Team and their respective regions: 4.4. Entrants must enter their username and password each time they access the Tipping Competition section of the We Love Footy website. 4.6. Entrants must select both: - the winning team for each match in a Tipping Week before the Tip cut-off deadline for the Tipping Week in question; and - the difference between the final scores (the “Margin”) of their Tipped winning team and the other team playing the nominated match (known as the “Margin Match”) in the free text box next to that match before the Tip cut-off deadline for the Tipping Week in question. 4.7. It is a condition of the awarding of each prize that the winner must, if requested to do so by the Promoter, sign and return any Affirmation of Eligibility to Enter, ownership of Entry, Release and Compliance statements provided to the winner by the Promoter. The failure to return the signed statements will result in the entitlement to the prize being forfeited and the selection of another winner. 5. LIMITATIONS ON ENTRY There is a limit of one entry per email address and one entry per person. 6. DURATION 6.1. This competition commences at the date specified in Condition 1.3. 6.2. Entries for each Tipping Week must be received by relevant Deadline, as set out in Condition 1.4. 6.3. The competition closes on the time and date specified in Condition 1.5. 7. SELECTION OF WINNERS 7.1. Entrants will be awarded points in each Tipping Week as follows; Pick a winning team correctly 1 point In the event of a draw all Tippers receive 1 point Pick an incorrect Tip 0 points Non submission of Tips Registered entrants are automatically assigned the away team with but are limited to 5 points . Late entry Should a Participant enter the Promotion after the commencement of any Round or Season, then the Participant will be allocated a default Score in the same manner as if they were a Participant at the commencement of the Season and had failed to enter any tips. 7.2 Round Margins. What you need to know about Margins The Margin Tippers are required to enter a winning team plus a margin for one game each round (the number of points team A will beat team B by). If you tip the winning Team and their exact winning margin, your 'Round Margin' will equal 0 points/goals (like golf, lower is better). •? If you pick the winning team, but not the winning margin, your 'Round Margin' will equal the difference between the actual game margin and the margin you tipped. •? If you tip the losing Team, your 'Round Margin' will equal the points/goals difference of the actual game margin PLUS the margin you tipped. The 'Total Margin' is the total to date of the Weekly Margins for all rounds in the tipping competition. As with 'Your Margin' the lower your 'Accumulative Margin' is the better ranking you will have. 7.3. In order to determine the results in each Round, Participants will be ranked: a) firstly by their Score, where the highest Score has the highest rank; b) then, in the case of a tie, by each Participant’s Round Margin for the same Round, where the lowest Round Margin has the highest rank; c) then, in the case of a further tie, by each Participant’s Accumulative Margin for the Season to date, where the lowest Accumulative Margin has the highest rank; and d) the, in the case of a further tie, the Participant who first initially registered to participate (either in a current Season or in a previous Season) has the higher rank. Round rankings will be determined no later than 72 hours after the last Match of the particular Round has ended. 7.4. Overall We Love Footy Tipping Competition Winner: At the completion of the Regular Season the winner will be determined on Tuesday, 4 September 2012 by: a) firstly by the Participant’s total Score for all Rounds; b) then, in the case of a tie, by each Participant’s Accumulative Margin for the Season; c) then, where Participants have identical Scores and identical Accumulative Margins, the Participant with the lowest Round Margin for the last Round within the Season will be ranked highest; and d) then, in the case of a further tie, the Participant who first initially registered to participate (either in a current Season or in a previous Season) has the higher rank. 7.5. End of Season rankings will be determined no later than 72 hours after the final Round of the Season has been completed on Tuesday, 4 September 2012 and will be drawn at the NSW WIN Television head office at Television Ave, Mt St Thomas 2500 7.6. Regional Tipping Team Competition Winners: At the completion of the Regular Season, the entrant with the overall highest number of total points within each Regional Tipping Team (calculated in accordance with the method set out in clause 7.4 above) will be the “Regional Winner” for their respective Regional Tipping Team, except where this entrant has been declared the “Overall Winner” of the We Love Footy Tipping Competition. In this event, the entrant with the second highest number of total points within the Regional Tipping Team (calculated in accordance with the method set out in clause 7.4 above) will be the “Regional Winner” for their respective Team. In the event of a tie 7.4d will apply. Regional winner rankings will be determined no later than 72 hours after the final Round of the Season has been completed on Tuesday, 4 September 2012 and will be drawn at the NSW WIN Television head office at Television Ave, Mt St Thomas 2500 7.7.For the avoidance of doubt, the entrant who is declared the “Overall Winner” of the We Love Footy Tipping Competition is not eligible to win a “Regional Winner” prize. 8. PRIZE 8.1. Overall Winner prize: A Harvey Norman shopping spree in the form of vouchers to the value of $5,000 8.2. Regional Winner prize: Each Regional Winner (2) will win an entertainment package from Harvey Norman. Recommended Retail Price: $2,500 8.3. Total value of all prizes: $10,000 8.4. All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. The prize is not transferable, exchangeable or redeemable for cash. In the event of that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner. This is subject to the approval of all relevant State and Territory Lottery Departments. 8.5. Unclaimed prizes will be held for three months. Should any prizes remain unclaimed after 10 December 2012, they’ll be re-awarded to the next eligible Tipster in accordance with the appropriate selection of winner conditions setout in clause 7. 9. NO QUALITY, ETC, REPRESENTATIONS/EXCLUSION OF LIABILITY 9.1. The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner and, where applicable, to any family/persons accompanying the winner. 9.2. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again. 10. WINNER NOTIFICATION AND PUBLICATION The winner will be notified by email and/or phone, using the details provided in their entry, and the name of the winners will be published as specified in Condition 1.4. 11. OWNERSHIP OF ENTRIES All entries become and remain the property of the Promoter. 12. PUBLICITY The winner consents to the use of his or her name, suburb of residence and image for promotional and marketing purposes and agrees to participate in reasonable promotional activities as requested by the Promoter. 13. INTERNET If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition. This is subject to the approval of all relevant State and Territory Lottery Departments. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. 14. ENTIRE CONDITIONS These conditions constitute the entire agreement of the parties relating to the entry and the conduct of the competition. 17. Instructions on how to enter and prizes form part of these Conditions of Entry. 2. The promotion is open to all residents of Southern New South Wales/ACT and Queensland over the age of 18. Employees and immediate families of WIN Network Australia Pty Ltd, WIN Television NSW Pty Ltd and their associated agencies are not eligible to enter. 3. The promotion commences 8th February 2012 at 10:00am and ceases Sunday 31st August 2012 at 10:00am. (Competition Period). There will be twelve (12) prize draws, six (6) for each region, conducted on a monthly basis during the competition period. 4. To enter the competition, participants must register their details with the We Love Footy (www.welovefooty.com.au) website and enter their footy tips on a weekly basis. The registration form will ask viewers for the following information: Full name, state, postcode, contact phone number, region and age. Information provided may be used to form a part of the WIN Television database, if you wish to not have your details placed on any database there will be an ‘opt out’ clause on the online entry form. All entrants must be over eighteen (18) years of age at time of entering. 5. Upon registration on the We Love Footy website, each participant will be allocated to a Regional Team based upon the region that they reside in; either “Southern New South Wales/ACT” or “Queensland”. Each Tipping Month, participants will go into their Regional draw to win that month’s prize. The 26 Tipping Weeks of the Regular Season will be divided into the following six months for the purposes of awarding monthly prizes: April 2012 Prize Draw: Tipping Weeks 1-4; May 2012 Prize Draw: Tipping Weeks 5-8; June 2012 Prize Draw: Tipping Weeks 9-12; July 2012 Prize Draw: Tipping Weeks 13-17; August 2012 Prize Draw: Tipping Weeks 18-21; September 2012 Prize Draw: Tipping Weeks 22-26. 6. This promotion is a game of chance. All participants that meet the above criteria will form part of the next monthly random draw. 7. Where an offered prize is no longer current, the promoter reserves the right to substitute a prize of equal or greater value. In the event that a re-draw takes place, the winner of the redraw will be awarded an alternative prize of the same or greater value. The re-draw will be made by an official WIN Television Representative and will be re-drawn at the NSW WIN Television head office at Television Ave, Mt St Thomas 2500 Monday, 10th December 2012 at 11am AESDT. The prize winner will be notified by phone and email. Winner details will be printed in the Australian Newspaper on Wednesday 12th December 2012. 19.
